You know Todd McFarlane, right? He's probably most known as the creator of Spawn and the guy who makes a ton of great toys. Well, Azeroth Advisor is holding a really cool contest in which four entrants will win the opportunity to have McFarlane draw one of their WoW characters!

For those who don't know, Azeroth Advisor is a free electronic newsletter that is customized to your character's current level and class based on information from the Armory. You get a newsletter for every one of your characters each week or each level, whichever comes first.

Promotion Description. 38 Studios and Azeroth Advisor (hereinafter, the “Sponsors ”) will randomly select four (4) entrants that will be given the opportunity to have Todd McFarlane draw a sketch measuring at least 8 ½” x 11” of a selected World of Warcraft character from the entrant’s World of Warcraft Online Game (the “Game ”) login screen (each sketch is hereinafter referred to as a “Prize ”) (the “Promotion ”). The Promotion begins on or about 12:01 a.m. Eastern Standard Time (EDT) on November 13, 2008 and ends at 11:59 p.m. Eastern Standard Time (EST) on December 31, 2008 (the “Entry Period ”). The approximate retail value of each Prize is $100 . By participating in the Promotion, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsors, which shall be final and binding in all respects. The Sponsors may terminate the Promotion at any time, in their sole discretion, with or without notice.

Eligibility. The Promotion is available only in the United States and District of Columbia (“U.S. ”) and is open only to legal U.S. residents who are 18 years of age or older as of date of entry (each, a “Participant ”). Employees and their immediate families and household members of the Sponsors and their subsidiaries, affiliates, and agents involved in the implementation and execution of the Promotion (collectively the “Promotion Parties ”) are not eligible. The Promotion is void in US Commonwealths, territories and jurisdictions (including overseas military installations) and where prohibited. The Promotion is limited to one (1) Prize per household. No two Participants may use the same email address. Receipt and use of the Prizes are subject to availability, cancellation or suspension pursuant to the terms and conditions related to the Game, and are subject to change. Participants may, but need not be, current subscribers of the Game. The Sponsor is not and will not be responsible for any winner’s inability to subscribe to or play the Game and/or obtain the equipment necessary to play the Game. Prizes awarded in the Promotion include only the artist sketches, and any subscription fee for the Game or required service, charge, tax or hardware is NOT INCLUDED. The Sponsors reserve the right to substitute the Prizes in whole or in part with other prizes of comparable or greater value for any reason.

How to Enter. During the Entry Period, visit http://azerothadvisor.com/ (the “Website ”) and follow the links and Promotion instructions to complete the entry form, subscribe to the Azeroth Advisor and register for the Promotion. By entering the Promotion, each Participant automatically becomes a subscriber to the Azeroth Advisor, consents to being placed in the Sponsors’ databases, and authorizes the Sponsors to send email notices to the Participant relating to products and services that are or may be offered by the Sponsors in the future. All on-line entries must be received by the end of the Entry Period. The Website’s clock will be the official time keeper for the Promotion. Limit one entry per person or email address. Alternatively, to enter the Promotion without subscribing to the Azeroth Advisor, print your name, street address, email address, telephone number and age on a piece of paper and mail it to 38 Studios LLC, 5 Clock Tower Place, Suite 140, Maynard Massachusetts 01754 Attn: Azeroth Advisor - World of Warcraft Guide Promotion Entry Form . Mail-in entries must be post-marked between November 13, 2008 and December 31, 2008 and must be received by the Sponsors by January 5, 2009. Limit (1) one entry per person.

All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Proof of entering information at the Website is not considered proof of delivery to or receipt by the Sponsors of such entry. All Participants must provide a valid email address to be eligible. In the event of a dispute regarding the individual who actually submitted an on-line entry, the entry will be deemed submitted by the authorized account holder of the email address supplied at the time of entry. “Authorized account holder” is defined as the natural person to whom the applicable email address has been assigned by the Internet Access Provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the address submitted. A potential Prize winner may be required to provide the Sponsors with proof that he/she is the authorized account holder of the email address associated with the winning entry. If a dispute cannot be resolved to the Sponsors’ satisfaction, the entry will be deemed ineligible. The Promotion Parties assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.

All entries become the property of the Sponsors and none will be acknowledged or returned. False, fraudulent and/or deceptive entries or acts shall render Participants ineligible for the Promotion.

Agreement to the Official Rules. By participating in the Promotion, each Participant (or if the Participant is not of the age of majority in his or her state of residence (an “Eligible Minor ”), his or her parent or legal guardian) fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsors, which are final and binding in all matters related to the Promotion. Winning a Prize is contingent upon fulfilling all requirements set forth herein.

Limit. One (1) entry per person. All winners are subject to verification by the Sponsors. A Participant is not a winner of any Prize, even if selected and/or notified by the Sponsors, unless and until the Participant’s eligibility has been verified and the Participant has been notified that verification is complete. Any attempt by any Participant to obtain more than the stated number of entries by using multiple or different addresses or email addresses, identities or registrations, or any other methods, will void that Participant’s entries and that Participant may be disqualified from the Promotion. Internet entry must be made by the Participant only at the Website. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including but not limited to commercial promotion subscription notification and/or entering service sites, will be declared invalid and disqualified for the Promotion. The use of any device to automate the entry process is prohibited.

Drawing/Odds. Winners will be selected by the Sponsors in a random drawing on or about January 15, 2009 from among all eligible entries received during the Entry Period. The odds of winning a Prize depend on the number of eligible entries received. The Sponsors will attempt to notify potential winners within seventy-two (72) hours of the drawing date via the email address provided at the time of entry. The Sponsors shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. Winners will be required to submit a screenshot, in JPEG (.jpg) format, of their selected character from the Game login screen within fourteen (14) days of being notified. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules, or declines a Prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. If the Prize Winner is an Eligible Minor as of the date of the drawing, at the Sponsors’ option, the applicable Prize will be awarded in the name of a parent or legal guardian of the Eligible Minor. If a potential winner of a Prize is disqualified for any reason, that Prize will be awarded in a second chance drawing conducted from among all Participants to award any unclaimed Prizes. A list of Prize winners will be posted on the Website from the drawing date to January 31, 2009 and will also be made available by mailing a self-addressed stamped envelope to 38 Studios LLC, 5 Clock Tower Place, Suite 140, Maynard Massachusetts 01754 Attn: Azeroth Advisor - World of Warcraft Guide Promotion, Winners List ; Washington State residents may omit postage.

General Conditions. All details and other restrictions of Prizes not specified in these Official Rules will be determined by the Sponsors in their sole discretion. All taxes (and the reporting consequences thereof) and any other fees or costs associated with a Prize are the sole responsibility of the winner of such Prize. The Sponsors may file an IRS Form 1099 with the Internal Revenue Service for the fair market value of Prizes awarded in the Promotion. The winners (or their parent if such winner is an Eligible Minor) will be required to execute and return an Affidavit of Eligibility/Liability Release and (where legal) a Publicity Release within three (3) days of Prize notification, or the Prize will be forfeited in its entirety and an alternate winner will be selected.

Release and Acknowledgment. By participating in the Promotion, each Participant agrees that the Promotion Parties (A) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Promotion or in any Promotion related activity, or from Participant’s acceptance, receipt, possession and/or use or misuse of any Prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any Prize and specifically disclaim all such warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose. Prizes will only be awarded to verified winners. If any Prize is unclaimed, there will be a random drawing to award the prize to an alternate winner within 14 days of the initial drawing. The Promotion Parties assume no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature, or any incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due entries. If, for any reason, the Promotion is not capable of running as planned, including, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsors reserve the right in their sole discretion to cancel, terminate, modify, suspend or extend the Promotion and, in the event of any termination or cancellation, select winners from among all eligible, non-suspect entries received prior to the termination or cancellation. The Promotion Parties are not responsible for any damage to a Participant’s cellular phone or computer system which is occasioned by accessing the Website, participating in this Promotion, redeeming or accepting a Prize, or by downloading any information necessary to participate in the Promotion. The Sponsors reserve the right to terminate on-line entry if technical difficulties compromise the integrity or ability to continue on-line entry. Any attempt by a participant or any other individual to deliberately damage the Website or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, is in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to disqualify the applicable individual and seek damages and other remedies from any such person to the fullest extent permitted by law. If any provisions of these Official Rules are determined to be invalid or unenforceable, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained herein.

Participant’s Personal Information. Anyone who enters the Promotion automatically grants the Sponsors permission to use his or her name in connection with promotion of this or other Promotions in any and all media without additional notice or compensation. Information collected from Participants is subject to the 38 Studios Terms and Conditions, the 38 Studios Privacy Policy and the Azeroth Advisor Privacy Policy. The use of the personal information of a winner of the Promotion is subject to the terms of the Official Rules (see paragraph above titled “Release and Acknowledgment”), and is not subject to the 38 Studios Privacy Policy or the Azeroth Advisor Privacy Policy.

Disputes. Participants and, if Eligible Minors, their parents and legal guardians, agree that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New Castle County, Delaware; any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and under no circumstances will any Participant be permitted to obtain awards for, and Participant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Participant’s rights and obligations, or the rights and obligations of the Sponsors in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules (whether of the State of Delaware or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Delaware.
