No, it means that you can't file suits/etc because it is upheld as being justified. Please tell me what definition of "discrimination" that you are using that doesn't support denying someone a job because of the color of their skin. What has happened is that society has recognized scenarios where the discrimination is accepted due to logic. At the end of the day, it's still discrimination.

No, but your claim was image.... yet, Abercromnie (not Gap) was sued for putting whites on floor sales positions. So where does it end? Those people were discriminating to increase sales as the white people fit the "image" of who they were targeting. Yet, if it were a model for something geared towards white people, then according to your source, it's ok. So then what's the difference between not hiring a person of a skin color in order to fit an image vs not hiring a person of a skin color in order to fit an image?
If you can't see that society has just accepted one over the other because it makes sense to cast a white person to act as a white person, then there really isn't anything else to say.
