Internet Sales TaxFollow

California decided it wanted needed to collect sales tax from online sales. From what I understand the ruling was something like any business that has any kind of brick and mortar type connection with Cali is subject to the sales tax.

The biggest player here is Amazon. Because there are tons of businesses in Cal that also sell stuff through Amazon. So, Amazon would be asked to collect a california sales tax on any products being sent to a Cal address.

Amazon's response was to dump all the businesses that had been selling stuff through their website. Smiley: disappointed

Other states as well, have been trying to get some bit of revenue from on-line sales.

So, on one hand you have brick and mortar stores that have to pay sales tax, competing with online companies that don't. I can see how that could suck.

On the other hand, you have online businesses that do business with all fifty states and lots of other countries. They all have differing tax rates on different categories of items, different systems of collection, etc etc. So, can they be asked to shoulder the burden of tax collection?

Should online sales be taxed regardless of where the shop originates?

How should it be done?

What about Amazon? I think their response to California, and more directly, those businesses that were booted out of Amazon's virtual mega-store was pretty poopy.

Texas wanted Amazon to pay a giant pile of back sales taxes ($269 mil) because they have a distribution center outside of Dallas. Rather than pay, Amazon is shuttering its Texas distribution center and canceling additional Texas facilities which would have employed ~1,000 people. I'm sure some state will be happy to give them exemptions in exchange for the employment. Amazon also has already severed affiliate business with Rhode Island, N. Carolina and Colorado -- I'm guessing CA is making the news because the the state's size.

I know Amazon has claimed that Illinois' attempts to collect sales tax was unconstitutional. They're making the same claim with California. I imagine at some point a court is going to have to make a decision.

I'm thinking that sales tax collections could end up being a transaction between the state and the individual resident of that state, with the seller only providing documentation.

Last year, IL started enforcing its "use tax" which is supposed to be difference in sales taxes owed if you buy something from out of state for use in Illinois (many/most states have this, it just hasn't been enforced). This includes unpaid internet sales taxes. They put a separate line for it on the tax form so it's hard to claim ignorance any more.

Flea railed against this and was ready to leave it blank but, unless you kept all your receipts, there's a formula to follow for a standard obligation and ours was some token sum ($20? $30?) that wasn't worth the risk of fines and penalties.

Back to Amazon, they've also been resisting attempts from states to get sales data from them which could help the states pursue people who haven't paid their own use tax obligations.

I'm not sure why the California legislator thought Amazon was just going to roll over on this. They did exactly what one would expect a corporation of that size to do.



All the more reason to tax based on income rather than expenditures.

The form explicitly stated that putting "$0" was not an option, which I thought was curious. I just filled in the minimum acceptable value ($3, I think) and sent it in.

It will be interesting to see, over the next decade or so, how this issue is resolved.

If I remember right, if the company you are buying from is located in your state, you pay state sales tax. Otherwise you do not pay state sales tax. (Though, you are probably supposed to claim something on your end of year taxes). There isn't a federal sales tax, so...

Only the State sales taxes and the "sin taxes" on things like Cigarettes and Alcohol.


I do think that sales taxes should apply to internet sales. Enforceability aside, it seems like it should just be any company that delivers ordered goods to a State should pay that States applicable sales tax, and pass that tax cost onto the customer. No different than buying it from your local stores.

Huh.

The seed catalouge company Burpee has always added a state sales tax for South Dakota customers for sales originating within SD. Is this a "you gotta pay sales tax regardless of state origination" deal?

Yes, this is dealing with purchasing things from outside your state online, and not paying state sales taxes, either for your state or the originating state.
