Yes, of course he's a pundit. The problem is that MSNBC has him titled (apparently) as a "news reporter". Laughable, but there you have it. So all of this time they've been billing his show as "news"? Really!?
I'm sure all those posters who claimed I didn't know the difference between news and opinion will chime in to condemn MSNBC right about now. Or... now. Ok. Maybe we'll have to wait a really long time.

No. What it means is that you can't tell the public you are reporting news and give them opinion instead. As long as you are clear about which you are doing, it's not a problem. You know. It's the whole "lying to the public" thing. I'm frankly curious why MSNBC cares about this. It's not like anyone takes them seriously anyway, but whatever.
