No. You take the law into your own hands and, well, you take the fUcking law into your own hands. You let the police show up before you brandish your machine gun and they can secure the mob and identify the offenders. Who are the cops supposed to pursue? The kids dispersed by the gunfire or the dude doin' the shootin'? Assuming they're all black.

Well the "victim" was black, so there's that. He should have waited inside and hoped they were still there when the cops arrived, but firing warning shots into his lawn is hardly worth charging him with a class D felony, IMO.

If it's as it appears, he'll probably get off with a warning, if that. But that doesn't mean the police don't make the arrest when he clearly broke the law by firing his gun.

Actually, he'll probably get slapped with a fine or something for misdemeanor discharge of a firearm, which doesn't sound unreasonable. I think the felony charge is a bit over the top though.

If I was to guess, the guy figured that firing his weapon and setting off the police "shots fired" alert system would get a quicker police response than waiting while his wife sits on hold with 911.

I don't know if I blame him and would assume he'll get a warning and not a felony conviction but the type of gun it was is pretty secondary. Especially since it's most likely that his weapon was a semiautomatic rifle (if it was full auto, I'm sure the story would have drooled over that fact as it did "AK-47" also the guy would have been charged with owning it).

I guess this might just be in my part of the country but there are special permits that allows private citizens to own automatic weapons. I know a guy who owns a M2HB. I had to pay him $100 to shoot 25 rounds at an old rusted out car. I'm sad to say it wasn't as awesome as originally thought.

Yeah, I get the impression that this was not some special permit owner. And I still assume the papers would have happily picked up on the fact that it was a fully automatic weapon.

The weapon was semi-auto and completely legal. You don't need any sort of permit to own that weapon in NY. No weapon charges were filed against the man. New York is very strict about what sort of force you can use against others, especially when they are not in your house. Outside doesn't count.
