First, it doesn't say that it was an automatic weapon. In fact, it says he had the weapon legally and was not charged for it so I'd guess it was a semiautomatic. Secondly, he intentionally set off an alarm by firing shots into the lawn. So what kind of gun it was is somewhat irrelevant since he wasn't exactly using it to go all Rambo on hordes of gang members.

Plus the fact that he fired first kills any self-defense claims even if it was his home. The "gang" members were not even inside his house yet.

The story in question took place in Long Island, quite a more civilized area.
Besides the rampant gang problem, of course.

Ignoring the typical Varus idiotic spin on things, and speaking directly on the merit of the actions being reported, I don't think the guy really did anything wrong. The questionable behavior in this story is that the cops would pursue legal charges against a man "defending" his home while completely ignoring the individuals who were supposedly threatening him and his family.

Sounds like the guy was anxious to use his gun. He provoked the "gang members" simply by showing it to them. Apparently all they were doing was gathering in front of his house. He could have just waited for the police to arrive instead of wasting his shots on his own lawn.
I've had people like that gather in front of my house before, threatening me and the like.. I was just a kid though. They said they had a gun. So I walked inside, and they went away. The world is full of teenagers who think they are badasses. The reality is though, they are pussies who are hoping you will pull out a gun so they can get you arrested.
