Sounds like a semantic defense there.
I both pointed out that it is not as widespread as most people believe, being used only on 3 people, all of them essentially terrorist upper management. These three had also previously confessed prior to torture/water boarding, in most cases stridently so. However, water boarding also did not generate any useful data. The CIA recognized this and has discontinued it.
So, there is a false dilemma here.
