Maybe if you got banned, there's a good reason.

The article wrote:
A PlayStation 3 gamer has filed suit in U.S. District Court in California, alleging that SCEA suppressed his free speech rights and caused him pain and suffering by banning his account on the PlayStation Network.

In a complaint filed on July 6th, Erik Estavillo of San Jose writes that he his disabled by a variety of disorders; among these are agoraphobia, a fear of crowds:

Estavillo's issues with SCEA apparently stem from his play of the PS3 hit Resistance: Fall of Man:

The ban is supposedly due to the behavior of the plaintiff when he plays the video game "Resistance: Fall of Man," which Sony owns and employs moderators for its online play. These moderators kick and ban players that they feel are deserving; though their biases to a player seem to be what determines the kick or ban...



The plaintiff was exercising his First Amendment Rights to Freedom of Speech in the game's public forum when he was banned from, not only [Resistance], but also banned from playing all other games online via the PlayStation Network...


Estavillo also claims that the PSN ban amounts to a theft of his pre-paid points:

The plaintiff...cannot access [his] money when a moderator from Resistance and Sony gives a player a arbitrary wide-range ban... which in essence, is stealing money from the player...


Estavillo also argues that the EULA for online play of Resistance is ineffective in blocking players under the game's recommended age of 17, although it's unclear how this fits into his claim.

In his request to the court, Estavillo, who appears to be unrepresented, asks that SCEA be enjoined from banning players. He also seeks $55,000 in punitive damages.

To date, SCEA has not filed a response with the Court. GamePolitics has requested comment on the lawsuit from SCEA.


Also, because it's relevant and not in the article (aside from the last):

The list of ailments he's claiming under "pain and suffering" wrote:
Obsessive-Compulsive Disorder, Panic Disorder, Major Depression, Crohn's Disease and Agoraphobia


(Specifically, he's saying that those have been exacerbated by the ban.)

Okay, let's point out where he's wrong, deluded, or otherwise an moran:

1) The First Amendment claim. Just because it's somewhere at least nominally public, like the Internet, does not mean you get to say what you want.
2) If they can't ban players, how are they supposed to get rid of the guy who keeps pos-hacking to shoot you in the back of the head?
3) Resistance is the only way he can socialize with other people? Has he never heard of other forums, or IRC?
4) Panic attacks, okay. Crohn's, maybe (I seem to recall we have someone around here with it who could confirm one way or the other). OCD... uh-huh. Depression... the fuck? Agorapho--NO. Being unable to play your game does not make your basement-dweller's syndrome worse.

This guy is either a complete toolbag, or the world's greatest RL troll ever.

Being unable to use the internet or any other net WOULD make the consequences of your basement-dweller's syndrome worse. I know this. But you're quite right that there's oodles of alternatives that he can find to hook up with other people on. I understand and sympathise with the guy having ONE particular game that is an addictive drug to him at the moment. I was like that with FFxi, and then with WOW. But he's got to take the consequences of breaking a TOS, and go find himself some other drug/game medium that gets him contact with other people.

The amount of hypochondria you find amongst modern gamers is astounding. I'd be amazed if he actually had even one of those conditions listed. I've met people who use **** like agoraphobia and Asperger's as an excuse for being an antisocial *******. It's simultaneously a moronic cry for attention and an insult to people who actually have those problems.

But seriously, this guy is whining to the max. I couldn't play WoW for a month or so over Christmas. Did I go into panic attacks? No, I fucking read a book. When I finished the book I rented some videos.

His ban was likely the result of him spewing more random expletives than a 12 year old Halo-addict on speed. Sucks when E-Thugging catches up to oneself because they chose to do it on a forum that was linked to an ID that, if banned, would affect them irl.

Although I do disagree with the ban from PSN as a whole, I paid one pile of money for my PS3 because I have a certain fondness for the playstation brand, and I didn't want to pay for an XBL subscription. In today's gaming age, no online play = no point in playing, for most games--especially now since single-console, multiplayer games are falling quickly out of style.

I also think that the ban from the PSN entirely might be a little harsh, if his ban was originally from something that happened in Resistance, then he should just be banned from the resistance servers, not the whole PSN. But, then again, there may have been some other random happenings that would justify the wide ban.


Other than that. Hearing people cry "Freedom of Speech!" when they're playing on commercial servers is HILARIOUS.

If he's that disabled, he needs to engage in mental health treatment specifically geared to helping him manage his agoraphobia, OCD or whatever. It's not Sony's fault or responsibility to provide a temporary holding environment for his symptoms. His mental health issues may be very real and need medication but that's not Sony's problem and they shouldn't be used as a solution.

They should let him back in, then immidiatly ban him again. Then ban his mom, ban his friends, ban his friends moms, ban all of nebraska, and anyone improperly using a vowel!

Then they can give him a banned aid.
