I was horrified when I read that on CNN's website. My husband remarked that since she had tried to commit suicide that she'd probably try the insanity defense but my opinion, is that it is pretty clear that she thought things out; She used CPR to bring him back and then suffocated him AGAIN.

Oh I think she's pretty clearly mentally ill, but since our "justice system" rarely recognizes such things in a meaningful way, she'll likely just be thrown in a cell for the rest of her life...never fear.

Don't get me wrong, what she did is absolutely horrific, but it's obvious to me that she sounds nutty as a fruit cake.

She was aware of what she did. If mental illness were black and white, yes she was ill but I think she is well enough to stand trial and understand that what she did was wrong.

In regards to being sent to jail. AT least from what I learned in my recent criminal behavior psych class, jails seem to be over utilized for the mentally ill. Also, if she does somehow get deemed insane, her time spent in a mental institution will be far longer than any jail sentence.

For first degree murder? I think you're applying general statistics to a specific situation. Not a good idea.

This seems more like 2nd degree murder to me. Given that she reconsidered and then reconsidered again, it doesn't really seem like a planned and premeditated action. Intended yes.

hmmm, realizing this is the states I looked up the US degrees of murder, and you guys seem to have a broader definition of first degree murder then we do, so I guess it could be first. You still have the premeditated tag though.

Possibly. I'd need to do some more research but I wasn't the bathtub drowning mother also 1st degree? While she is initially charged, will that be what she ends up with after pleading?

An insanity defense doesn't seem that easy to accomplish anymore. Also, depending on her state she could be found Guilty but "insane". (some states seem to have that classification as opposed to guilty or "insane")

Yeah, bla bla. The salient point is that people who are found NGBROA for murder don't serve less time than people found guilty and subject to mandatory life sentences.

I have to say, I respect the USA for the fact that, over there, life means life . Over here, it means an average of 13.7 years .

Of course, I'm also of the view that if someone confesses to a murder, we should shoot them in the head and save some money for the taxpayers .

Why would you do it in the first place? I can't imagine the thought process she must have had going on to justify smothering him a second time. I don't even know what to say, I'm saddened for both mother and child but just feeling disillusioned as to the state of humanity that you could kill your own child TWICE.
