Remember the giant loophole in the laws regarding US contractors in Iraq which leaves the Blackwater security officers basically immune from the law? It's not just good for shooting civilians, you know!

Story with lots of words, even after trimmed down

"We contacted the State Department first," Poe told ABCNews.com, "and told them of the urgency of rescuing an American citizen" -- from her American employer.

Poe says his office contacted the State Department, which quickly dispatched agents from the U.S. Embassy in Baghdad to Jones' camp, where they rescued her from the container.

Jones told ABCNews.com that an examination by Army doctors showed she had been raped "both vaginally and anally," but that the rape kit disappeared after it was handed over to KBR security officers.

Over two years later, the Justice Department has brought no criminal charges in the matter. In fact, ABC News could not confirm any federal agency was investigating the case.

Legal experts say Jones' alleged assailants will likely never face a judge and jury, due to an enormous loophole that has effectively left contractors in Iraq beyond the reach of United States law.

Congressman Poe says neither the departments of State nor Justice will give him answers on the status of the Jones investigation.

Since no criminal charges have been filed, the only other option, according to Hutson, is the civil system, which is the approach that Jones is trying now. But Jones' former employer doesn't want this case to see the inside of a civil courtroom.

KBR has moved for Jones' claim to be heard in private arbitration, instead of a public courtroom. It says her employment contract requires it.

In arbitration, there is no public record nor transcript of the proceedings, meaning that Jones' claims would not be heard before a judge and jury.

I don't know what I'm saying.. crap like this has been going on a long time. We know it's wrong and f'd up but there's not much we can do. I believe there is a post on the OoT about an Austrailian interviewing stupid americans.

Those people that don't know what country starts with a U are the reason sh*t like this goes on.

Apparently, after further examination, it was determined that there were indeed, no marks left, so the rape kit was useless.

The 'rape kit' (Duct tape, pointy knife, broom handle, video etc?) was destroyed when it was clear that for it to remain intact was to endanger the anonymity of the agents involved.....

Well, we can ensure that companies working in Iraq as subcontractors of the United States government remain under the auspice of the US government's laws or under military jurisdiction. That doesn't seem like it should be too much to ask as long as we're cutting the checks.

Hell, that's not even on the assumption that she's telling the truth. But when someone makes an accusation of rape and has to be rescued by the State Department from her own employeer (I assume Congressman Poe is being truthful) then there should be an actual investigation and a means of prosecuting the appropriate parties.

Trust me, I agree with you.

Honestly other than writing my representative there isn't much I can think of to do.

The problem is the majority of Americans are tied down to a 40+hour/week job to pay for our standard of living. Most people that would be taken serioiusly can't just get up and have an old fashioned march on the capitol.

I guess I am a little jaded. It's things like this that rub me the wrong way. Big government so to speak. The untouchables.

I'm for changing the administration, upholding the constituion, and abolishing the Patriot Act.

If this story actually has some truth behind it, it's gonna be a tough one to explain away.

There's an election next year. At the very least, your president and your House Rep are up for a vote. Depending on how much you want to put into it, the answer ranges from "vote for whomever you think will effect change" to "actively agitate to influence the elections in favor of this goal" to "run for office".

Can you guarantee change? Probably not. But you can certainly do more than sigh deeply and lament your 40 hour work week.

I'm not exactly lamenting about my 40-hour workweek. It's more about the indentured servitude type lives we lead so we don't have the time to do anything like influence elections other than voting at the polls and writing letters.

I'm fine with working. I pefer it. Gives purpose to life and I find it fufiling.
