A woman arrested for exposing her breasts has accepted a $29,000 settlement from the city, her lawyer said.

Jill Coccaro, 27, was arrested on a topless stroll two years ago, despite a 1992 state appeals court ruling that concluded women should have the same right as men to take off their shirts.

Coccaro, who now goes by the name Phoenix Feeley, remained in custody for 12 hours before she was told prosecutors were not going to pursue charges.

Her attorney, Jeffrey Rothman, told the Daily News that his client won the civil rights settlement from the city, which did not admit or deny wrongdoing.

"We hope the police learn a lesson and respect the rights of women to go topless," Rothman said.

In a country filled with "frivilous" lawsuits, I'm glad every now and then there truly is a civil case where the victim get's what they deserve.

Three cheers for a women's right to go topless!

I remember the court ruling and I have since, had cause to remind beautiful women that they need to excercise their right to go topless as often as possible.

And it was a reasonable settlement too, not the usual "one hundred gazillion dollars for emotional traumabuggery" deal.

she should have been given 2 days pay and $1000 for the inconvienience, then pointed toward the nearest journo for a big money story payout.

That's probably my favourite frivolous lawsuit ever. It's better than the fat guy who sued McDonalds. But what do you guys think, should women be able to do that?

If you spend 12 hours in a NYC jail because the police arrested you in specific violation of a Court Order from the highest court in the state, then I would not consider that frivolous and rather at $29K the city got a bargain, that's only $14.5K per bewb. The plaintiff could have easily gotten punitive damages, considering it was not a grey area, but a specific act the courts have ruled not illegal.

Made me think of an encounter I had with a exotic dance bar manager a few years ago.

I was especially ticked when they started doing the no smoking in bars, so I approached about a tactic I had seen used in another city, that got the citys attention.

Get the girls to go out on the city street to have their smoke breaks, topless of course...since they can't smoke inside. Perfectl legal, and pretty damn effective to the most people in an uproar.

She refused. Said it was ethically wrong to do, whether or not the no smoking crap was killing her business or not.

I clicked the link hoping for a picture. I think the law should be amended to include that only hot chicks are entitled to the right to walk around topless. If she was a big, fat German type old lady walking around with her ugly *** ******* flapping in the wind that would just be indecent. ****, I would have arrested her too.

While it's legal to be topless on NY beaches and parks etc., most people do not know it. I only hope the publicity from this helps spread the word. Based on a recent unofficial survey I made of Long Beach NY this past weekend, luckily by a darwinian twist of fate, of the few that do know, it seems only the hot women have the nerve to do it.
