Road rage turns to shooting in garageFollow

Wednesday afternoon in Fenwick, east of Greenville in Montcalm County, Mitchell Fitzgerald allegedly shot Eric Harrington in Fitzgerald's garage. Fitzgerald's family told 24 Hour News 8 he was driving home when Harrington, traveling in the other direction, drove into Fitzgerald's lane and caused him to swerve off the road.

There are conflicting stories to what happened when the two passed each other, but Harrington turned around and followed Fitzgerald to his home. Skid marks are visible where Harrington stopped in front of Fitzgerald's home.

Witnesses describe a chaotic scene in the garage and driveway. Eventually, they say Fitzgerald shot Harrington, 26, with a 16-gauge shotgun just below the right knee.

Fitzgerald's fiance said Harrington was threatening Fitzgerald's family. "I heard this guy saying, 'I'm going to come back, I'm going to come back with guns and get you and get your family,'" Nicole Russo said.

Fitzgerald's stepfather and grandfather arrived on the scene trying to control the confusion." He acted like he was in a rage, it didn't matter who got in there, he wanted to hassle with them," said Scott Palmateer. "As I recall he had sucker-punched me, wheeled back around like he was going back after Mitchell."

Scott Palmateer said Harrington acted like he was leaving, then turned around, looking for Fitzgerald. After a few warnings, Fitzgerald shot Harrington.

Fitzgerald, 20, was charged Thursday with great bodily harm less than murder.

24 Hour News 8 checked state law about using force on your own property, and found a law designed to protect homeowners who fear for their life. The Castle Doctrine allows a person who is on their own property and feels their life or someone else's life is in danger to use non-lethal force.

But the prosecutor, Andrea Krause, said, "given the facts as I know them, I believe the appropriate charge was filed." Beyond that, investigators aren't commenting.

The extent of Harrington's injuries aren't known, but they are not life-threatening.

One time I accidentally stole someone's parking space (didn't see him waiting around the corner of a car) at Costco. I was getting out of the car when I hear a horn honking non stop and I look and this guy is revving his engine honking his horn and pointing at me. Realizing what I'd done, I got back in and left the stall.

As soon as I was out, he vroomed his bigass SUV full speed into the stall. Nevermind that he could have easily crashed his precious fucking gas guzzler into a stone wall. He had to show me how mad I made him.

Road rage scares the crap out of me. Smiley: frown

Road rage is scary ****.

Today
Olivia Donachie was killed on Wednesday afternoon, when a green Jeep Cherokee mounted the pavement outside her home in Redford Drive, Colinton, Edinburgh, pinning her to a wall. Her mother Rachel, 33, a staff nurse, sustained serious injuries.

Police said the tragedy had been triggered by a road rage incident and the driver had been involved in two collisions minutes earlier.


Also today
The injured driver told investigators that the ice cream truck driver was tailgating his Dodge pickup truck, so he stopped to confront the ice cream driver. A fight broke out. The ice cream driver stabbed him twice and drove off, deputies said.

May 5, 2007
Orange County, Fla. -- Orange County Deputies say a pregnant woman was driving with her family when someone fired shots at her truck on Pine Hills and Beggs Rd.

The bullets missed the pregnant mother, father, and shot just inches above the 2-year-old girl who was sitting in her car seat.

Investigators believe the disgruntled driver was angry when the pregnant woman slowed down for a red light. They are considering it a road rage incident.


Personally, I think we should ban it.

Ugh I couldn't read the whole thing because it made me feel ill... but why in the world would you tell your wife just as she's going into surgery? What if she doesn't make it? Isn't it better to die not knowing your little girl is dead? Boy I feel down now... someone post some kittens to make me feel better.

LOL! That's got to be the silliest thing I've seen all week.

Reminds me of the dog my quadraplegic boss had. She was such a cute dog, but we weren't allowed to touch or pet her because it might make it so she listened to someone else than him... and he couldn't pet her himself...

Protecting one's family, or unjustified use of force?


Lots of gray areas in this situation.
1) If you have a gun and are being threaten physically by someone who is unarmed, can you reasonably feel you life is in danger because the threatening party could take your gun and use it against you?
2) If you use a gun to shoot someone in the leg is it the same use of force as trying to shoot him in the chest?
