By a Republican appointed judge. Who would have though it possible?

Tuesday's ruling thwarts the government's bid to seek $43.5 million prosecutors allege Lay took by participating in Enron's fraud. The government could still pursue those claims in civil court, but they would have to compete with any other litigants also pursuing Lay's estate.


I'm sure his "estate" is pleased. On to the civil suits!

The 43 million was intended as damages/fines for his criminal act. Since the guy's dead, it kinda doesn't make too much sense to apply them. It would have just ended up being 43 million fewer dollars available for the victims of his actions to sue for to recover their damages.

Unless you think the government would have done more to rectify the damage caused by the guy then the civil suits that will follow will?

That's a pointless argument, actually. It doesn't matter that he's dead; his estate theoretically still owed the damages.

It was vacated because the appeal was still pending when he died, which effectively denies him the right to put on an effective defense in the appeal.

when a shark dies, what it leaves behind is quickly gobbeled up by the other sharks.

hes dead, so now the sharks are fighting over who gets controll of his remains.

a fitting end. the only thing all of you can count on is that the people who lost their retirements and their futures will never see a dime of it no matter which pack of sharks gets controll.
