KORVEL ODD was in the Twilight Zone.

For two months, from mid-November 2004 to mid-January 2005, Odd languished in the Curran-Fromhold Correctional Facility, trying to figure out why he was there, and desperately trying to convince somebody - anybody - to set him free.

Odd, 42, was jailed at the request of a Philadelphia assistant district attorney - not as punishment for a crime, but to ensure his testimony as a witness in a murder case.

Yet, even after the murder charges were dismissed, no one bothered to release Odd from prison.

Odd - who finally obtained his freedom after sending a written plea to a public defender - is suing the assistant district attorney who jailed him, Tom Malone, and the district attorney's office. His suit was filed in federal court in May.

"The evidence will establish that Mr. Malone was deliberately indifferent to the needs of my client for his liberty," Odd's attorney, Daniel Silverman, said in an interview.

"He was the only one in the entire system who knew why he was in jail," Silverman said of Malone. "I can finally use the expression 'Kafka-esque.' "

Malone, who has left the D.A.'s office to practice civil law, referred all inquiries about the case to the D.A.'s office, which is representing him in the matter.

Cathie Abookire, spokeswoman for the D.A.'s office, issued this statement:

"Nobody should be in jail unless there is a specific legal justification. The reason for this person's imprisonment and the responsibility for effectuating his release are the subject of the litigation."

Silverman did not want Odd interviewed for this story.


Im thinking the defendant in this case should be jailed while awaiting trial just for the hell of it

And in jail, every new person there complains that they shouldnt be there, so I am not surprised that no one listened to him

Does this guy have like no friends or family, don't you still get to use a phone in prison now and then? Or was he in solitary for whinging about being innocent. lol

I would if he lost his man virginity in prison?

I'm not surprised in the least.

My brother, very... err Caucasian in appearance, was jailed for attempted murder. His accusers, four illegal (re: Hispanic) aliens said he jumped them. My brother said they jumped him. He managed to fight them off with a two inch knife he uses for cutting open boxes at work. One of them was seriously injured. He (stupidly) never reported it ("it's the way of the street, yo. Yo never snitch." Dumbass). They, of course, did. He was arrested. The assistant D.A was bound and determined to prove the attack was racially motivated (I.E. she believed my brother was a white supremacist). She could never prove it (and he wasn't). He was released after four months in jail because they could not (surprise! surprise!) find the four "victims" to testify.

That sounds a lot like a Law&Order:SVU I saw.


Wait a minute.. We all know git is a "lawncare professional" (aka ********* so how could his brother be caucasian?

Except your brother was accussed of a crime. This guy was suppose to testify in a murder trial and even after the murder charges were dismissed he wasn't released. Yeah I can see how you're not suprised. Smiley: oyvey

Simple. Git is the one of the four who jumped his own brother and then refused to show up to testify.

My point, 'tards, was that he was kept in jail for four months for attempted murder charges based on specious evidence, obvious story holes and an assistant DA bound to make a name for herself by takin' down the evil KKK'r. I.E. Look another ***. DA more interested in winning the case then caring about the people involved.

Actually Git, he was arrested and held for 4 months not as a criminal but as a witness. There were no charges, just held in order to appear as a witness at trial.
But you did try. There's points in there somewhere for you. You sure did try.
