man acquitted in sex assault because he was asleepFollow

A judge in Toronto has acquitted a 33-year-old man of sexual assault, accepting evidence he was asleep during the attack.

"His conduct was not voluntary," said Justice Russell Otter in a Toronto Sun report.

The woman in the case cried and left the courtroom upon hearing the acquittal and said she fears the ruling could set a precedent.

"I believe the floodgates have been opened," said the woman, who adds she will pursue her case "to the highest level."

The court heard Jan Luedecke and the woman met at a party in July 2003. Both had been drinking and the woman fell asleep on a couch. She woke up to find him having sex with her and pushed him off.

Luedecke testified he only suspected he had been having sex when he went to the bathroom and discovered he was wearing a condom. He confessed to police.

Sleep expert Dr. Colin Shapiro testified that Luedecke had parasomnia, a disorder with symptoms such as sleepwalking. The doctor also said Luedecke suffered from "sexsomnia," which is sexual behaviour during sleep.

Luedecke previously had sex with four girlfriends while asleep.

The court also heard Luedecke had cut down on his drinking and is taking medication to stop his sexsomnia

Apparently the other night i started playing with my fiancee's puty poo. I thought it was just a dream but she asked me about the next day and had no clue what she as talking about. She told me that I said "Give me that p*ssy" while i was asleep. I don't remeber any of this but she still gives me a hard time about.

She said she kept wondering if i was going to do anything about it, because i supposedly had a hard on for quite a while. So i could see his story being true.

I just happened to watch a show about sleepwalking crimes the other night, and the debate about whether somnambulism can be used as a legal defense. Lots of study done about how complex actions can be accomplished while sleepwalking - including one defendent who managed to drive 14 miles across town to kill his inlaws - and was aquitted.

Thanks man ... thanks is all I can say. Now I am going to be freaking out when I sleep at night. My SO talks in her sleep and has been known to sleepwalk every now and then.

I guess I better not **** her off. She may have a good defence!

My husband has made the moves on me numerous times while asleep.

How do I know he's really asleep? His moves are different than when he's awake! Smiley: lol

Number one thing: Never ever ever ever wake them up. I watched the same show and in both cases, the people who got whacked woke the person up thinking they were awake.

I had the same thing happen back in college. I was fast asleep and a guy I was dating, something of a hard drinker, decided he wanted to tap something other than a brew and I woke up to full-on bootknocking.

Good times.

Better not wake her up. Sleepwalkers react badly to that.
In most cases, the activities usually tend towards things like binge eating and peeing in the closet. My sister did that when she was young.

I wasn't really sleep walking as I was extreamly drunk. However, at one time during my wild years of adolecance I decided that taking a **** on my freind's sofa was a good idea. To this day I can't figure out why. I even lifted the seat cusion as I apparently thought it was a toilet.

I think i've had sex while sleeping too. Or atleast i can remember waking up while having sex...
One time my wife got out of bed and pissed in the corner by the door. I was like what the hell are you doing??? She didn't answer me, and had no idea what i was talking about in the morning.
I have a sleep walking story too, but it's too ****** up to share. Enough said...

My husband has been known to do the deed while he was asleep and vaguely has a recollection of it the next morning. He's also done numerous things while he was asleep or extremely drunk. He gets very impulsive when he's drinking. One time after some serious sailor drinking with his buddies, he decided it would be a great idea to barbecue at 3:00 a.m. I came downstairs the next morning to find my kitchen table just loaded with grilled steaks, hotdogs and other goodies.
