I thought it got nerfed and wasn't counted as an affliction DOT anymore?
it is still counted as an afliction effect, the 'nerf' wasn't an afliction one. it was that shadow embrace can't proc nether protection or additional darkmoon card: crusade buffs or anything else that procs off those type of things.
