What they did that irked yo so much was the fix. It wasn't suppose to work against any level mob, and never fail. As far as I know it's still the same, as I haven't heard different. However, knowing how SoE works, they may have over done the adjustment and reverted it back some, but I'm sure it still has some sort of a level limit and failure rate.
