Curious if anyone has done this or knows. Can my lvl 85 tier 5 merc be given to my lvl 78 and will it still be a lvl 85 t5 or does it drop to the lvl of my other toon?
The mercs are not transferable. You will need to do the progression on your 78 in order to get the t5. In additon, mercs are the same level as your toon, so you can't have a level 85 merc on a level 78.
It drops to the level and tier. You can transfer it. I have done it several times. Just be sure your lower toon has the transfer fee plus upkeep costs on hand.

When I unlocked J5, I transferred my then-85 J1 healer to a level 83 alt so I could buy a J5 warrior.
The recipient character must have that tier of mercenary unlocked via progression, and it doesn't cost anything to do the transfer if the recipient is the same or lower level.
